Terms and conditions
These terms explain how Clyde Workboats Ltd handles website use, enquiries, vessel hire and marine support services unless a separate written quotation, booking confirmation or signed contract says otherwise.

These terms are intended to sit alongside any quotation, booking confirmation, rental agreement, method statement or signed project contract. If those documents conflict, the more specific written document takes priority for the relevant work.
Customers
Business and private customers
Most Clyde Workboats work is supplied to businesses, public bodies, contractors, landowners, vessel operators and project teams. If you are acting mainly for your business, trade, craft or profession, you are treated as a business customer.
If you are acting mainly for personal, domestic or private leisure purposes, you may have consumer rights that cannot be excluded or reduced by these terms. In that case, cancellation charges, liability wording and service changes will be applied only so far as they are fair and lawful.
Agreement
Enquiries, quotations and bookings
An enquiry does not create a confirmed booking. A booking is confirmed only when Clyde Workboats accepts the work in writing and any required deposit, purchase order or other confirmation has been received.
You are responsible for giving accurate project, site, access, timing, vessel, passenger, cargo and contact information. We may ask for identification, company details or additional operational information before confirming a booking.
A person placing a booking, signing a quotation, issuing a purchase order or instructing work confirms that they have authority to bind the customer named in the booking.
Hire
Vessel hire and rental period
Vessel hire is subject to availability, operational suitability and weather. Hire periods are normally booked as full operational days, with start times, finish times and shift length confirmed before the booking.
Unless agreed otherwise, a hire day is treated as a minimum 10-hour day. Work outside the agreed time, overruns or out-of-hours attendance may be charged at an enhanced rate.
Vessels, skippers, crew, deckhands, lifting equipment, generators, pumps, lighting, welding equipment and other support items are supplied only where included in the accepted quotation or booking confirmation.
Charges
Prices, VAT, payment and late payment
Payment terms will be set out in the quotation or booking confirmation. Unless agreed otherwise, short hires of up to three days require a 25% deposit, and hires longer than three days require a 50% deposit.
Any remaining balance must be paid before the hire or service date unless Clyde Workboats has agreed different payment terms in writing.
Prices are exclusive of VAT unless stated otherwise. VAT and any other applicable taxes will be charged where required. Invoices must be paid in cleared funds by the due date shown on the invoice.
Additional charges may apply for mobilisation, demobilisation, fuel, missing or damaged safety equipment, additional crew, extra equipment, third-party costs, waiting time, changes to scope and work outside the agreed operating window.
For business customers, overdue sums may attract statutory interest, fixed compensation and reasonable recovery costs where UK late-payment legislation applies. Clyde Workboats may pause or cancel further work if payment is overdue.
Responsibilities
Client responsibilities
You must use any vessel, equipment or service only for the agreed purpose and must comply with applicable maritime, harbour, site, environmental and health-and-safety requirements.
- Do not use any vessel or equipment in an unsafe, unlawful or unauthorised way.
- Do not operate, board or work around vessels while under the influence of alcohol or drugs.
- Make sure passengers, contractors and visitors follow all reasonable safety instructions.
- Obtain site permissions, access approvals, consents and information needed for the work unless we have agreed to do this in writing.
- Secure cargo, materials and third-party equipment that are not under Clyde Workboats control.
Information
Site information, permissions and hazardous materials
You must provide accurate and timely information about the site and job, including charts, berth details, access restrictions, tidal windows, ground or seabed conditions, lifting requirements, existing mooring details, passenger numbers, cargo details and any known hazards.
You are responsible for obtaining permits, landowner or harbour authority approvals, welfare arrangements and site access unless Clyde Workboats has agreed to arrange them in writing.
Hazardous, polluting, explosive, oversized, unstable or unusual cargo, materials or work activities must be disclosed before booking. Clyde Workboats may refuse or stop work if the information provided is incomplete, inaccurate or creates an unacceptable risk.
Operations
Safety, skipper authority and weather
All passengers and personnel must wear the life jackets or personal protective equipment required for the operation and must follow instructions given by the skipper, crew or Clyde Workboats representative.
The skipper or site lead may delay, change, refuse or stop work where conditions, conduct, access, equipment condition or operational information creates a safety, legal, environmental or vessel-protection concern.
Weather, tides and marine conditions can affect marine work. If conditions are unsuitable, Clyde Workboats may cancel, delay or reschedule the work. Weather-related cancellations are normally rescheduled at no extra charge, subject to availability and any unavoidable third-party costs.
Delay
Events outside our control
Clyde Workboats is not responsible for delay or failure to perform caused by events outside its reasonable control, including severe weather, unsafe sea state, harbour or authority restrictions, breakdowns despite reasonable maintenance, pollution incidents, labour disruption, emergency response, illness, supply-chain failure or other circumstances that make the work unsafe, unlawful or impractical.
Where this happens, Clyde Workboats will take reasonable steps to reduce disruption and discuss revised timing, scope or cost where practical.
Changes
Cancellation and rescheduling
Cancellation terms may be confirmed in the quotation or booking confirmation. Unless agreed otherwise, cancellations made more than 14 days before the hire or service date are normally refunded, less any costs already committed with your approval.
If you cancel within 14 days, the deposit may be retained. If you cancel within 48 hours of the start time, sums already paid may be non-refundable. Changes requested by you are subject to availability and may affect price, timing and scope.
For private customers, any retained deposit or cancellation charge will be limited to a reasonable amount reflecting costs, commitments and losses that Clyde Workboats cannot reasonably avoid. Your statutory rights are not affected.
Risk
Insurance, loss, damage and liability
Clyde Workboats maintains insurance for its business operations. You remain responsible for loss, damage, claims, fines, delays or costs caused by your misuse, inaccurate instructions, unsafe conduct, unauthorised work, third-party property or breach of these terms.
You must report damage, incidents, near misses, pollution events or safety concerns as soon as possible. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any liability that cannot legally be excluded or limited.
Commercial liability limits, indemnities and insurance requirements may be set out in a quotation, contract or project-specific agreement.
For business customers, Clyde Workboats is not responsible for indirect or consequential business losses, loss of profit, loss of contract, loss of production, loss of opportunity or delay damages unless expressly accepted in a written contract.
Services
Moorings, pontoons and marine service work
Service work such as mooring inspection, installation, repair, pontoon support, lifting support, welding, survey attendance and logistics depends on site conditions, access, tides, weather, third-party permissions and the condition of existing equipment.
Estimates are based on the information available when they are prepared. If additional defects, unsafe conditions or extra work are found, we will discuss the revised scope, timing and cost before proceeding where practical.
Inspection reports, photographs and measurements record the visible condition at the time of attendance. They do not guarantee future condition or remove the need for continuing inspection after storms, vessel impacts, third-party interference or normal wear.
Supply chain
Subcontractors, records and confidentiality
Clyde Workboats may use suitably skilled subcontractors, suppliers, crew, equipment providers, yards, hauliers or professional advisers where needed to deliver the work.
Operational records, photographs, inspection notes, safety documents and correspondence may be kept for business, insurance, audit, legal and quality-management purposes. Confidential project information will not be used publicly without permission unless disclosure is required by law, insurers, regulators, professional advisers or safety obligations.
Ending work
Suspension and termination
Clyde Workboats may suspend or end a booking or service if you do not pay on time, provide materially inaccurate information, fail to obtain required permissions, breach safety requirements, misuse vessels or equipment, become insolvent, or create a legal, environmental or operational risk.
Termination does not remove liability for charges, committed costs, damage, loss or obligations that arose before the work ended.
Website
Website information and acceptable use
The website provides general information about Clyde Workboats services, vessels and capabilities. Vessel availability, specifications, service details and pricing may change and should be confirmed before relying on them for a project.
You must not misuse the website, interfere with its operation, attempt unauthorised access, submit malicious content or use the site in a way that breaks applicable law.
Website text, images, logos and other content belong to Clyde Workboats or its licensors and must not be copied or reused without permission except where allowed by law.

Privacy and cookies
Personal information submitted through this website is handled as described in the privacy notice. Cookie and browser-storage information is explained in the cookie notice.
Contact
Notices, governing law and contact
Formal notices should be sent by email or post using the contact details on this page or the details stated in the relevant quotation or contract. Changes to these website terms will apply from the date they are published, but will not change a confirmed booking unless agreed or legally required.
These terms are governed by the laws of Scotland, and disputes are subject to the jurisdiction of the Scottish courts unless a written contract says otherwise.
